Conclusion of the contract
By your purchase order, you submit a binding offer to conclude a contract, to Bellani Composites d.o.o. The purchase contract is caused by Bellani Composites d.o.o. accepting your purchase offer by the dispatch of the good. The automatic confirmation e-mail after the receipt of the purchase order does not constitute an acceptance by Bellani Composites d.o.o. It only confirms that Bellani Composites d.o.o. received your offer to purchase. For cash in advance payment Bellani Composites d.o.o. submits the bank account information by e-mail. This e-mail does not constitute an acceptance by Bellani Composites d.o.o. The text of the contract is stored. The automatic confirmation e-mail after the receipt of the purchase order contains the purchase order data. At any time you are able to visualise Bellani Composites d.o.o.'s General Terms and Conditions on this site. The purchase contract can be concluded in English language.
Right To Cancel
You are entitled to cancel your offer to conclude a contract within 14 days, with no necessity to state reasons. The period of 14 days starts with the handing over of the goods to you or a third person you appointed, except the carrier. In order to cancel your offer to conclude a contract, you need to declare clearly in writing the wish to cancel. A clear declaration can be done by conventional mail, fax or e-mail, or via Contact Us link. You are welcome to use the sample request for cancellation included within the paraph stated bellow 'Sample request for cancelation'.

Consequences of cancellation
In case of a valid cancellation, we are returning all payments we received from you, including delivery costs (exempted are delivery costs, which result from a different shipping method than our standard, most cost effective shipping fee) within a 14 day time period. This period starts with the day we receive your cancellation request. Refunds will be done by the same payment method chosen when making the order unless otherwise agreed.
We can refuse refunds until the goods are back and carefully checked, unused, undamaged in original packaging and made sure none of the parts are missing.
You are obliged to ship items back to us without delay and at the latest 14 days from the day you informed us of the cancellation request. You pay for shipments back to us.

A clear declaration can be done by conventional mail, fax or e-mail, or via Contact Us link. The on-time dispatch of the cancellation will do to comply with the period for cancellation. You are welcome to use the sample text for cancellation request bellow:

Payment
If paying by advance payment, you will transfer the money directly into our bank account in advance. Please keep in mind that you have to borne bank fees which might be charged with advance payments from abroad. Bellani Composites d.o.o. has to receive the total invoice amount.
Payment by credit card and PayPal will only be triggered off when the good is dispatched. With Express Checkout procedures like Amazon Pay or Paypal Express Checkout an immediate debit is possible.
If you select cash on delivery for paying (if active for you as an option), Bellani Composites d.o.o. can subsequently change the payment condition to payment per invoice that is cheaper for you.
Retention of title
Warranty claim
The warranty period is 2 years and commences on handing over the good, if not stated otherwise. Your warranty claims are limited to subsequent compliance (removal of defects or replacement) in the first place. Within this period, all guarantees will be resolved in your favor either by repair, replacement with a new item or, in the last resort, by a refund. If you notice that your item is defective in any way, please contact us first at info@bellanicomposites.com.
In order to process your complaint request as soon as possible, please send us the necessary documents to initiate the complaint procedure.

Photos must clearly show the advertised item. In the case of a complaint about the bicycle frame, it is necessary to take a picture of the entire bicycle, the clearly visible serial number located under the drive shaft and the damage to the frame that triggered the complaint (from several angles). Please make the photos clearly visible and no larger than 1MB per photo. In the case of a claim for an individual item, equipment or clothing, it is necessary to take a picture of the entire damaged item, a clearly visible detail of the damage (from several angles) and the serial number of the item (if any).
The warranty is only valid if the item has been used and maintained according to the manufacturer's instructions, i.e. according to the usual regulations. The warranty does not cover damage that would occur in the event of a fall, collision, impact, overloading, as well as interventions and repairs during the warranty period outside of an authorized service center or as a result of poor maintenance of the item.
The warranty does not cover standard wear and tear of consumables such as: rolling bearings, tires, inner tubes, brakes, brake and gearbox bushings, brake and gearbox cables, brake pads, bulbs, drive gears, chains and cassettes, cranks, rings, batteries, etc.
The warranty on a specific item is not transferable and is valid only for the first customer. The invoice as proof of purchase is mandatory for all complaint procedures.
Any item that will be repaired or replaced under warranty, the warranty period will be extended for the period that the item was being repaired.
The use of the article/bike during competitions, public events, rentals or activities for which the particular article/bike is not intended greatly reduces the useful life and in this case the article is not covered by the warranty.

Limitations of liability
The following liability exclusions and limitations apply to any liability borne by us for damage and expenses incurred in vain, without prejudice to the other legal requirements for claims.
(1) We are liable if we are guilty of intent or gross negligence. We are only liable for simple negligence in the event of a breach of an obligation, the fulfilment of which is a prerequisite for the proper performance of the contract and the observance of which the contractual partner may regularly rely on ("cardinal obligation"). In all other respects, liability for damages of any kind, regardless of the basis of the claim, including liability for fault in conclusion of a contract (culpa in contrahendo), is excluded.
(2) Insofar as we are liable for simple negligence pursuant to Paragraph 1, our liability shall be limited to the damage that we could typically expect to occur according to the circumstances known at the time of conclusion of the contract.
(3) In cases of simple (minor) negligence in accordance with Paragraph 1 Sentence 2, we are not liable for indirect or unforeseeable damages, nor for consequential damages (especially in the case of purely economic loss and lost profit)
(4) The above exclusions and limitations of liability also apply in favour of our employees, vicarious agents and other third parties whose services we use for the performance of the contract.
Online dispute resolution
According to a special regulation of the European Union, from February 15, 2016, disputes related to online purchases can be resolved throughout the EU via a platform that you can access here. This means that if you encounter a problem during an online purchase within the EU (defective product, inability to exchange the product, etc.), you can submit your complaint at the above link. The platform can be used by both consumers and traders, and complaints can be submitted in any of the 23 official languages of the EU.
